Terms of Service for Focus Mode Media Social Studio

1. Agreement to these terms

These Terms of Service govern your access to and use of Focus Mode Media Social Studio, a Postiz-based social media scheduling and content-preparation web application operated by Focus Mode Media (collectively, the “Service”). Focus Mode Media Social Studio helps users connect supported social accounts, prepare captions and media, and manage review workflows before content is posted on third-party platforms. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be legally able to enter into these Terms. You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and all activity conducted through your account. Notify us promptly if you suspect unauthorized access.

3. Third-party connected social accounts

Focus Mode Media Social Studio may allow you to connect accounts operated by third-party social platforms. Your use of each connected account remains subject to that platform’s terms and policies. You represent that you have authority to connect and manage each account. Focus Mode Media does not control third-party platforms and is not responsible for their availability, actions, data practices, or changes.

4. TikTok draft upload workflow

When you connect TikTok, Focus Mode Media Social Studio uses TikTok Login Kit and the Content Posting API only with permissions you authorize. TikTok uploads are handled as draft uploads for the connected account owner to review, edit, and post in TikTok. Direct posting to TikTok is not enabled unless separately disclosed and authorized.

5. Acceptable use

You may not use the Service to:

• violate any law, regulation, intellectual-property right, or privacy right;
• publish unlawful, deceptive, harmful, abusive, or infringing content;
• send spam or engage in unauthorized automated activity;
• interfere with, probe, disable, or circumvent security or access controls;
• introduce malware or attempt unauthorized access to systems or accounts;
• resell or misuse the Service except as expressly permitted.

6. Your content

You retain ownership of content you submit or schedule. You grant the limited rights necessary to transmit, process, store, and publish that content at your direction and to operate the Service. You are responsible for your content, including having all necessary rights and permissions.

7. Service availability and changes

We may update, suspend, or discontinue features, and the Service may experience interruptions or delays. Scheduled publishing can be affected by connected platforms, networks, credentials, or other circumstances outside our control. We do not guarantee uninterrupted availability or successful delivery at a particular time.

8. Intellectual property

The Service, excluding your content and third-party materials, is protected by applicable intellectual-property laws. No rights are granted except the limited right to use the Service under these Terms. Third-party names and marks belong to their respective owners.

9. Termination

You may stop using the Service at any time. We may restrict or terminate access when reasonably necessary to protect the Service, users, third parties, or comply with law, including for material violations of these Terms.

10. Disclaimers and limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind. Focus Mode Media disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. To the extent permitted by law, Focus Mode Media will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or business opportunities arising from the Service.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Focus Mode Media from claims, damages, and reasonable expenses arising from your content, your use of the Service, your connected accounts, or your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute must be brought in a court of competent jurisdiction located in Texas, unless applicable law requires otherwise.

13. Changes to these terms

We may revise these Terms from time to time. The “Last updated” date will identify the latest version. Continued use after revised Terms take effect constitutes acceptance where permitted by law.
